What Records Must a New York Insurance Company Keep in a Claim File?

Under 11 NYCRR § 216.11, every insurer subject to Part 216 must keep within each claim file all communications, transactions, notes, and work papers relating to the claim, and must date all communications and transactions — written or oral — that it sends or receives. Claim files must be maintained so that Department of Financial Services examiners can reconstruct every event in the claim, and insurers must either note in the file or keep a copy of every form mailed to a claimant.

    Key Points

    • All communications, transactions, notes, and work papers stay in the claim file.
    • Oral communications count and must be dated.
    • The file must let a DFS examiner reconstruct the entire claim.
    • Forms mailed to you must be noted in the file or copied.

Why the record rule helps policyholders

Section 216.11 exists for DFS market conduct examinations, not as a consumer document-request right. But it has real practical value: it means there is a dated record of the phone call an adjuster now says never happened, the internal note explaining a reduction, and the consultant work paper behind a denial.

When a claim becomes a genuine dispute — a DFS complaint, appraisal, or litigation — that file is what gets examined. Knowing it must exist changes how you document your side: dated written submissions match dated file entries, and vague verbal promises do not.

    Build your own mirror file

Keep a single folder with the date of loss, the date of first notice, every submission you sent with its date, every carrier letter, the § 216.5 list of required items, your proof of loss, the carrier's estimate, and a call log with names, dates, and what was said.

That file is what a public adjuster or attorney can act on immediately, and it is what makes a DFS complaint concrete rather than general.
